The rules and conditions described below (referred to as “General Terms and Conditions”) govern the use of this website, regulating the relations arising between the supplier BALKAN AND DE BARBER EOOD and the persons using the online portal and online store accessible on the website https://balkanbarber.com/, (hereinafter referred to as the “Site” or “Website”) for the purchase and sale of goods.
If you use this website, you are deemed to accept and agree to the stated General Terms and Conditions. If you DO NOT ACCEPT these terms, do not use this website!
In connection with the above, please read these General Terms and Conditions carefully before using the website or requesting and making a purchase of goods from the online store.

1.2. User
Any adult (over 18 years of age) and able-bodied natural person, with a permanent address in the Republic of Bulgaria, who has agreed to these General Terms and Conditions and uses the website for the purchase of goods, hereinafter referred to as “User”, “Client” and/ or “You” and which natural person, as a party to the distance selling contract, is acting outside the scope of his trade or business, trade or profession.
By registering on the website, the User declares that he is an adult (over 18 years old) and that he has the appropriate degree of legal capacity to enter into transactions for the purchase of goods from the online store.

The www.balkanbarber.com website consists of an information portal, an appointment booking platform and an online store through which “Balkan Barber” offers and sells services and products. The content of the Website aims to provide information about the Services and Products and how to use them. The content of the Website is for informational purposes only and does not constitute a product or service recommendation, nor is it intended to encourage the purchase of a product.
To access and navigate (including shopping as a guest) through the Website, the user does not need to register a user profile.
III. Registration
To create a User Profile, the User should:
– fill in a valid email address in the registration field;
– confirmed that he has familiarized himself with and accepts these general terms and conditions and the Personal Data Protection Policy of “Balkan Barber”.
Upon registration, the User will receive confirmation of successful registration, as well as his username and automatically generated password, with which he must activate his account.
After activating his profile, the User can supplement it by specifying names, delivery address and contact phone numbers, and if he wishes, he can change his access password.
When, in the process of registering a User Profile, the User selects the “Registration of a profile on the site” check box, he expressly makes an electronic statement within the meaning of the Law on electronic documents and electronic authentication services.

“Balkan Barber” reserves the right to publish advertising banners of any kind, as well as electronic references (links) from any part of this website, subject to compliance with the legislation in force in the Republic of Bulgaria.
VI. LIMITATION OF LIABILITY
In connection with the use of the Website and the electronic store, the User should bear in mind that:
The Company shall not be liable if for any reason (technical or otherwise) the User is unable to access the Website at any time.
In case of an established violation by a User, “Balkan Barber” reserves the right to terminate his access to the website, without any obligations arising from this termination for us.
The Company is not responsible and does not give guarantees for the content of other sites that can be accessed through electronic references (links) published on the Site. All electronic references (links) on this website are provided solely for the convenience of the User.
The company is not responsible in the event that when using the website or materials from it, the user incurs damages that require repair or repair of equipment or loss of information, and all costs related to the removal of such damages are at the expense of The user.
The Company is not responsible for the inaccurate performance of a contract for the purchase of goods from the online store in the event that the User has provided incorrect or incomplete data.
The company is not responsible for differences between the prices of the goods in the electronic store indicated on the Site and the prices announced in other electronic stores or commercial outlets for sales of the same goods. In these cases, the prices published in the online store of this Website shall apply.
The Company is not responsible for the difference in the colour of product images arising from the contrast and settings of the User’s monitor.
VII. PURCHASE OF GOODS
In order to make a purchase from the electronic store, the User does not necessarily have a registered account. However, if the User has a registered account, he must log in and can place an order at any time.
To make a valid order, the user with a registered profile should:
– log in to your account;
– select a product to place in the shopping cart;
– fill in delivery details, billing details and a current phone number, once filled in they remain saved but can be corrected whenever the user wishes.
The request is considered submitted after marking the check box: “I am familiar with and agree to the General Terms and Conditions” and pressing the “Order” button.
The completion of the order by pressing the “Order” button has the effect of an electronic statement within the meaning of the Law on Electronic Document and Electronic Authentication Services.
After receiving the request, “Balkan Barber” sends a notification email to the User that his order has been accepted.
The confirmation of the specific order by “Balkan Barber” is the condition under which the contract for the purchase of goods from the electronic store is considered concluded. Sending confirmation of the specific order binds “Balkan Barber” and the User to the terms of the contract described in these General Terms and Conditions, as well as to the relevant provisions of the Consumer Protection Act and the Act on the provision of digital content and digital services and the sale of goods.

VIII. PRICE
All prices are in BGN with VAT included. The final price that the user owes is formed by the price of the products, plus the price of delivery of the products (if such is due according to the General Terms and Conditions for Online Purchase).
IX. METHODS OF PAYMENT
Orders are paid according to your choice, using one of the methods specified in the e-store. When choosing a payment method other than cash on delivery/payment on delivery, you agree to pay the price of your order in advance through a virtual POS terminal/Paypal account.
When paying for the order by cash on delivery, the User pays the announced value of the cash on delivery, including the price of the purchased Product and the cost of delivery (if such is due according to the General Terms and Conditions for Online Purchase) to the courier at the time of delivery, payment being made in cash, in Bulgarian leva.
The Courier will provide the User with an invoice/receipt stating the total amount due, including the price of the Product purchased and the cost of delivery (if any). The User should hand over the entire amount due to the courier and the payment should be noted in the document certifying the delivery of the Product, and this document also serves as a receipt for the payment made.
X. DELIVERY
The goods are delivered by courier companies. As the company reserves the right to choose the subcontractor carrying out the delivery, without being obliged to inform the users, as long as this does not reflect the terms, prices, methods and other conditions of delivery specified here. Only goods are delivered according to orders requested by the user and confirmed by the supplier. The ordered goods are delivered in their original packaging.
The delivery period is from 1 (one) to 3 (three) working days from the day of confirmation of the relevant order by the Supplier. During this period, the order is processed, and the ordered goods are handed over to a courier and delivered to the User. Delivery is carried out only on the territory of the Republic of Bulgaria.
Orders placed before 12 noon are processed the same business day. Orders placed after 12pm are processed the next business day.
It is possible to extend the above-mentioned delivery period due to unforeseen circumstances beyond the Supplier’s control (for example, inaction/delay on the part of the courier given his visit schedule for the specific settlement, unpredictable weather conditions, strikes, etc.).
The goods are delivered throughout the country (the territory of the Republic of Bulgaria), to the address specified by the User. The cost of delivery (if such is due according to the General Terms and Conditions for online purchase) as well as the time required for delivery by the forwarder depend on the final place of delivery of the order.
Although we strive to fulfil all orders accurately, the fulfilment of your order may be prevented for any of the following reasons:
1. We do our best to have stock and update stock promptly, but it is possible that some of the ordered products are not available. In this case, we will contact you as soon as possible by phone or email.
2. You have provided incorrect or incomplete delivery details – names, addresses, telephone, and postal codes. The company is not responsible for the non-fulfilment of the order as a result of incorrect information submitted by the User.
If the delivery of the ordered goods is impossible, the conditions specified by the courier companies apply.
XI. PASSING OF RISK
The risk of loss or damage to the goods passes to the User at the moment when the User or a third party specified by him (recipient of the goods), other than the courier, accepts the goods.
XII. LEGAL WARRANTY
The User has the right to make a complaint about the Product under the statutory warranty for consumer goods by sending an electronic message to the following email address: shop@balkanbarber.com.
XIII. RETURN OF GOODS
The user can cancel his order before it is prepared for delivery by sending an email to shop@balkanbarber.com.
Orders placed before 12:00 may be cancelled until 3:30 p.m. on the same day. Orders placed after 12:00 may be cancelled until 10:00. the next day.
The user has the right, without owing compensation and without giving a reason, to withdraw from the contract and return the goods received within 14 days from the day of receipt.
In the notice of cancellation of the contract, you must indicate the number and date of the order, the date on which the goods were received, the courier company through which the goods were received, a description of the goods whose return is requested, the price of the goods that was paid, Your name, mailing address, telephone number and contact email address.
The goods subject to the online purchase contract which you withdraw must be returned to us without undue delay and in any case no later than 14 days after the day on which you informed us of your withdrawal from the contract by sending by post/courier to the address: Sofia, Prespa St. 7, recipient: “Balkan Barber”.
If you wish, you can send the goods at the same time as sending your statement of withdrawal from the online order contract (that is, within 14 days from the date on which you received the goods from the courier).
The product must be returned:
1) in good commercial condition and in its original packaging, without traces of mechanical and other damage to the packaging, as well as to the product itself, such as crumpling, scratching and others;
2) in a complete set, as the goods were purchased (in case the goods are a set of several separate products, it is necessary to return all products);
3) together with proof of payment of the price (original receipt or other document certifying payment of the price).
If these conditions are not fulfilled, we reserve the right to refuse to accept the returned goods and not to refund the amount paid by you.
In the event that you cancel an order, we will reimburse you for all payments we have received from you in connection with the purchased goods, by bank transfer to a bank account specified by you or with the same means of payment that you used to pay for its value, without undue delay and in any event but no later than 14 days from the date of receipt of the notice of refusal.
We may withhold refunds only until we receive the goods or until the consumer provides proper proof that the goods have been sent back to us, whichever is earlier. You must bear the direct transport costs of returning the goods to our following address: Sofia, 7 Prespa St.
In cases of refusal of an online purchase, the User is solely responsible for reducing the value of the Products as a result of their testing, other than what is necessary to establish their nature and characteristics.
In the event that the order refers to several goods and only some of them are returned, or only some of them meet the conditions for return, the Supplier refunds only the price of the returned goods that meet the conditions for return.
The Supplier is not responsible for delays in receiving the returned amounts from the Customer if the latter has provided incorrect bank information or for other reasons beyond the Supplier’s control.

XIV. CHANGE TO TERMS AND CONDITIONS
“Balkan Barber” reserves the right to change these General Terms and Conditions at any time without prior notice to Users. The changes take effect from the day they are published on the website and are effective in the future, without affecting orders confirmed before that moment.
XV. ADDITIONAL PROVISIONS
Right to change published information
“Balkan Barber” reserves the right to change the information published on the Site at any time. Amendments are effective immediately (except for amendments to these General Terms and Conditions, to which the provisions of Section XIV apply) and become binding on the Parties to the General Terms and Conditions from the moment they are published on the Website.
The user is obliged to keep his username and access password confidential and not to disclose to third parties.
By accepting the General Terms and Conditions, the User gives his express consent:

– to receive notifications from the Company by telephone and/or electronically, including via email – communication or publication of a notification on the Site.

XVI. APPLICABLE LAW
The provisions of the civil legislation in force in the Republic of Bulgaria apply to all issues not settled by these General Terms and Conditions.
All disputes regarding the interpretation or implementation of these General Terms and Conditions and the related contracts for online sales of goods through the electronic store will be resolved by agreement between the Parties, and if it is impossible to reach an agreement, the disputes will be referred for resolution to the relevant generic competent court in the city of Sofia.
If any of the provisions of these General Terms and Conditions is declared invalid for any reason, this invalidity does not affect the validity of the remaining provisions, insofar as the invalid provisions are replaced by relevant mandatory normative rules or insofar as the Parties to these General Terms and Conditions can validly bind in contractual relations even without the invalid parts of the General Terms and Conditions.
